$5 Million Award to Family of 7-Week Old Baby Who Died in Hinsdale Hospital
Illinois' Second Highest Jury Verdict For Infant Death

HINSDALE, Ill., Oct. 23, 2015 /Standard Newswire/ -- A Cook County jury returned a verdict today awarding $5,072,030.14 to the parents and twin sister of a 7-week old baby who died in the emergency room of Hinsdale Hospital in Hinsdale, Illinois on May 16, 2008. The jury deliberated for approximately three hours before returning the verdict against the emergency room physician, Dr. David Mayor, and his group, Emergency Health Care Physicians. The trial judge was Judge James McCarthy, who conducted the trial at the Richard J. Daley Center in Chicago.

Eli G. Haig was born on March 21, 2008, with a rare congenital heart defect known as hypoplastic left heart syndrome. With this syndrome, the left side of the heart is severely underdeveloped. Until the late 1980s, any child born with this syndrome would die within a matter of days after birth. Today, such babies normally have three surgeries within the first two years of life, but still have only a 50% chance to be ten years old.

The lawsuit was brought in the name of Eli J. Haig, the baby's father. Additional claimants with Haig were the baby's mother, Polla Haig, and the boy's twin sister, Francesca.

The attorneys representing the infant's estate, Jerry A. Latherow and Bridget Duignan of Latherow Law Office, indicated that the baby was given a depressant medication called Versed, in order to stop his crying. Previously on May 5, a week and a half earlier, Eli had been given the same medication in the same emergency room, in response to his crying.

Excessive crying for hypoplastic left heart babies is known to be a precursor to cardiac arrest, after which the baby dies. According to Latherow, the baby was not crying when he was given the fatal dose of Versed, so there was no need for any type of sedative to have been given to him on that occasion.

Eli's pediatric cardiologist recommended hydration, among other things, prior to giving Versed. In Eli's case, Dr. Mayor failed to take appropriate steps to insure that the baby was hydrated and he failed to examine the baby before the administration of Versed. Latherow and Duignan reported that due to the baby's dehydration, Eli was unable to properly absorb the Versed, which then caused cardiac arrest. Additionally, they alleged that Dr. Mayor failed to intervene for approximately ten minutes after the baby suffered a decrease in heart rate. This misadministration of medication and failure to respond to a life threatening condition combined to cause the baby's death.

The deceased baby is survived by his parents, twin sister and a younger brother born in 2011, three years after Eli's death.
